First-degree murder suspect, Greg Miller Jr. of Frederick, will be bound over for trial in the February 2015 death of his girlfriend’s one-year-old son. Judge Brad Benson found sufficient evidence at a preliminary hearing Monday to schedule a trial before Judge Darby’s court at 10 a.m. on March 4.

Miller and the baby’s mother, Kelly Fairchild, rushed the child to the hospital after they found him unresponsive last February, but because of suspicious bruising and cuts on the child, hospital officials alerted police. During the preliminary on Monday, it was said that the autopsy report was sealed.

Fairchild had told investigators that Miller had stepped on her son while trying to let the dog out, but Miller told investigators several stories including one that said he accidentally nicked the boys head while he was drunk that night and did not remember if the boy cried out or not. Miller was charged with first-degree murder.

Fairchild is being charged with child neglect – enabling felony. Her preliminary hearing, originally set for Feb. 25, has been rescheduled for March 3.
